General Terms and Conditions
Supanz-Immobilien assumes a special relationship of trust between the broker and the client when accepting an order. We are committed to the professional performance of our brokerage activities and to providing perfect service.
Mutual rights and obligations:
I.) We act as a referral agent and/or broker for buyers and sellers.
II.) The brokerage commission is due as soon as a legally effective contract has been concluded through our referral or mediation (contributory cause is sufficient).
The commission claim remains valid even if the contract expires due to a condition subsequent, a reserved or non-reserved right of withdrawal, or for any other reason, or if it becomes irrelevant or cannot be fulfilled. If the contract is concluded at a later date or under different conditions, our commission claim shall remain valid.
If, as a result of our activities, an economically comparable contract is concluded instead of the contract option offered, the customary local commission shall be payable for this.
The commission claim shall also arise if the purchase contract is concluded on terms that deviate from the offer (e.g., purchase price reduction), or if and to the extent that further contractual supplements and additional agreements are concluded in temporal and economic connection with an initial contract.
The brokerage commission amounts to:
III.) Purchase and sale of real estate for the seller and buyer: 3.57% of the purchase price, including statutory value-added tax.
IV.) Heritable building rights, calculated on the basis of the value of the land and the (planned) heritable building, 3.57% including statutory value added tax for the landowner and the beneficiary of the heritable building rights.
V.) Right of first refusal, calculated on the basis of the market value of the property (payable by the beneficiary) at 1.16% including statutory value added tax.
VI.) For the purchase and sale of companies or shares in companies, calculated on the basis of the contract value, 3.57% including statutory value-added tax for the seller and buyer.
VII.) If, as a result of our referral or brokerage activities, both contracting parties enter into direct negotiations, we must be informed of the outcome of these negotiations immediately and without being asked. Upon conclusion of the contract, the client must inform us of the contracting party for the commission claim. We are entitled to be present when the contract is concluded. We must be notified of the date in good time. We are entitled to receive a copy of the contract and all related ancillary agreements.
VIII.) If a property proven or brokered by us is initially rented or leased and purchased within the next 5 years, the commission agreed for the purchase shall be due upon conclusion of a purchase contract, less any commission payments already made.
IX.) Our offers are subject to change and non-binding. All information is provided based on information provided by the client. We reserve the right to make omissions, errors, and prior sales. Claims for damages against us are excluded.
X.) The offer is intended solely for the recipient. The recipient is personally liable for the commission claim in the amount of the total commission for the transaction in question to our company if the offer is passed on to third parties, even if the recipient is an authorized representative.
XI.) Proof of the properties offered by us shall be deemed accepted if the recipient does not immediately after receiving the address or the exposé provide us with written proof that the property has been offered to them in writing by another party and has been proven on site. In the case of an exclusive mandate, any prior knowledge of the property by the interested party shall be irrelevant.
XII.) Statutory value added tax shall be added to the brokerage commission. We reserve the right to agree on an individual commission rate or to specify this in writing in the property description or on our website.
XIII.) The client has no claim to the performance of a service free of charge and cannot claim damages if the property in question does not appear on our website or in the daily press.
XIV.) All verbal, telephone, and other commitments and subsidiary agreements must be made in writing (including by fax or email) to be valid and must be confirmed in writing by the other party.
Cancellation policy
Right of withdrawal for consumers
You have the right to withdraw from this contract within fourteen days without giving any reason. The withdrawal period is fourteen days from the date of conclusion of the contract. To exercise your right of withdrawal, you must inform us (Supanz-Immobilien, Hammer Dorfstr. 112, 40221 Düsseldorf, fax no. 0211 3033882, info@supanz-immobilien.de) of your decision to withdraw from this contract by means of a clear statement (e.g. letter sent by post, fax or email). To comply with the cancellation period, it is sufficient to send the notification of exercising the right of cancellation before the cancellation period expires.
Consequences of withdrawal
If you revoke this contract, we shall reimburse you for all payments we have received from you, including delivery costs (with the exception of additional costs resulting from your choice of a type of delivery other than the cheapest standard delivery offered by us), without undue delay and at the latest within fourteen days of the day on which we receive notification of your revocation of this contractand no later than fourteen days from the day on which we receive your notification of withdrawal from this contract. We will use the same means of payment for this refund as you used for the original transaction, unless expressly agreed otherwise with you; in no event will you be charged for this refund. If you have requested that the services begin during the withdrawal period, you agree to pay the local brokerage commission for purchase properties in the amount of 3.57% including statutory VAT of the sale price.
Should any of the above provisions be or become invalid, this shall not affect the validity of the remaining provisions.
The place of performance and jurisdiction is Düsseldorf.
